Construction Site Accidents

- Defense of an electrical subcontractor alleged to have negligently installed an electrical service entrance panel which later exploded, causing plaintiff to sustain third degree burns over fifty percent of his body.
- Defense of an insulating contractor against a claim for contractual indemnification filed by the developer arising out of injury to a construction worker who, while disposing of trash, fell through a temporary safety rail at a Northern Virginia construction project.

| Contract Disputes - Change Orders and Delays |
- It is the rare construction project that is completed without some dispute over the scope of work in the contract or a claim of delay by one party or another. We have represented a number of contractors and subcontractors on claims that certain work should have been included in the original contract price or is properly the subject of a change order. Delay claims are particularly difficult to prove. Our attorneys understand what is required to establish that a project's critical path was disrupted by one of the participants in the construction process.

- There is no greater frustration for the general contractor or subcontractor that completes its work on schedule to not be paid in a timely manner. In these circumstances, we have filed mechanics' lien actions to protect the rights of our clients and pursued payment for our clients. We have also defended owners against claims for contract balances by asserting back charges and delay claims.

- Government contracting agents frequently fail to comply with government contracting regulations, and the savvy contractor must be aggressive in insuring that its bid receives fair consideration. We have successfully represented clients in bid protests involving state and federal projects. We also have experience in asserting and defending claims on behalf of our clients under the Miller Act and Little Miller Act.
